Terms of service

1. Who you are contracting with
berlinflats.net is operated by Bloom Computing Ltd (company number 16578589), registered in England & Wales at 71–75 Shelton Street, Covent Garden, London WC2H 9JQ (“we”, “us”). By creating an account you agree to these terms. If you don’t, don’t. Contact: hello@berlinflats.net.
2. What the service is
We collect sublet and room offers posted publicly in Berlin Telegram groups, structure them (price, area, dates, type), and show them to you filtered and ranked by preferences you set. That is the whole service.
We are not an agent, broker, landlord or intermediary. We do not verify listings, vet the people who post them, hold deposits, or take part in any arrangement you make. You contact posters yourself and any agreement you reach is between you and them. Treat every listing with the caution you would apply to any classified ad, and never send money for a place you have not seen.
3. Your account
You must be at least 18. We sign you in by emailing a single-use link, so anyone with access to your inbox can access your account — keep it secure and tell us if it is compromised. One account per person; accounts are not transferable.
4. Price, trial and payment
- The subscription costs €9 per month, recurring until you cancel.
- New accounts get a 3-day free trial. Valid card details are required to start it. One trial per person — we use your payment record to enforce that.
- Unless you cancel during the trial, the first charge is taken when it ends, and monthly on that date afterwards.
- Payments are processed by Stripe. We never see or store your card details. If a payment fails, Stripe retries; if it keeps failing your subscription is cancelled and access stops.
- We may change the price with at least 30 days’ notice by email. The new price applies from your next renewal, and you can cancel before it takes effect.
5. Cancelling
Cancel any time from your settings, in two clicks, without asking us. Your subscription then stops renewing and your access continues to the end of the period you have already paid for. We do not refund part of a period you cancel mid-way, except where the law requires it or where we have got something badly wrong — ask, and we will be reasonable.
You can also delete your account outright, which cancels the subscription and erases your data as described in the privacy policy.
6. Right of withdrawal — and your express consent to waive it
As a consumer in the UK or EU you would normally have 14 days to withdraw from a distance contract for digital services. Access here begins immediately, which is the point of it.
By starting your trial or subscription you expressly request that we begin supplying the service immediately, and you acknowledge that you therefore lose your right to withdraw once the service has been fully supplied. You confirm this by ticking the box at checkout. This does not affect your right to cancel future renewals at any time under section 5, and it does not affect your other statutory rights.
7. What you may and may not do
- The service is for your own personal flat search.
- Do not scrape, bulk-export, republish, resell or redistribute the listings, and do not access the site with automated tools.
- Contact details in a listing may be used to enquire about that listing, and nothing else. No marketing, no bulk messaging, no adding people to anything.
- Do not share your account, and do not try to reach data belonging to other users.
We may suspend or close an account that breaks these rules, and will refund the unused part of the current period unless the breach was deliberate.
8. Availability
We aim to keep the site up and the listings flowing, but we do not promise either. Groups go private, Telegram changes, servers fall over. There is no uptime guarantee and no promise about how many listings will appear in any given week — and no promise, obviously, that you will find a flat.
9. Liability
The listings are third-party content. We are not liable for their accuracy, for anything a poster does or fails to do, or for a place turning out to be a fraud. To the extent the law allows, our total liability to you is limited to the fees you paid us in the 12 months before the claim.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot legally be limited — including your non-excludable rights as a consumer.
10. Changes to these terms
We may update these terms. If a change materially affects you we will email you at least 30 days beforehand, and continuing to use the service after it takes effect means you accept it. Otherwise the current version is the one on this page.
11. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer resident elsewhere in the UK or the EU, you keep the protection of the mandatory consumer law of the country you live in, and may bring proceedings there.
